Arrested while driving? You have the right to legal representation and can defend yourself against charges. Consulting with an experienced attorney is advisable.
There are three different kinds of DWAIs in New York State:
DWI – Driving While Intoxicated (impaired by alcohol)
Beginning in 2025, New York is enforcing stricter penalties for repeat DWI offenders.
DWAI – Driving While Ability Impaired
Driving while ability impaired by drugs is a serious criminal offense.

DWAI/Drugs Alcohol Combination – Driving While Ability Impaired by a combination of drugs and alcohol. This can include prescription drugs, over-the-counter medications, illegal drugs, and alcohol.

AUO- Aggravated Unlicensed Operation
An AUO arrest occurs when a person is caught driving while their driver’s license is suspended or revoked. It’s a Misdemeanor offense and can lead to significant penalties like fines, jail time, and further license suspension. In New York State, the DMV recently passed new regulations that drastically change the landscape for first-time offenders, resulting in a far longer potential revocation than in the past depending on your driving history.

Please note that laws and regulations can change over time, so it’s important to consult with a legal professional or refer to official sources for the most up-to-date information.
